If you are in an accident while at work and are injured, you may be entitled to workers' compensation. If you are injured at work, it is very important that you take the correct steps to ensure you receive the compensation you may be entitled to.

Seek Medical Attention

It is imperative that you seek medical attention first and foremost to ensure that you are not injured further. Even if you feel okay and do not think you need medical attention, see a doctor anyway. A report from a doctor immediately following your accident at work may be necessary for you to ultimately be paid the compensation you may deserve. Also, you may not realize how serious the injuries you suffered are.

Also, make sure you provide the doctor or emergency room physician you receive medical treatment from after your accident with a very detailed account of the accident and what caused it. The more detailed the report, the less difficult it will be when the time comes for you to file for compensation.

Alert Your Employer

The next important step is to ensure that your employer is made of aware of exactly what happened and what injuries you suffered. Talking to your employer in person is best, but sending a letter or e-mail in addition would provide you with the paperwork necessary to prove that you made your employer aware of all of the circumstances to the best of your ability. Simply telling your employer you will not be able to work will not suffice. Supply your employer with as much detail as possible.

Under Florida state law, you must alert your employer of your on-the-job injury within thirty (30) days. The sooner, the better.

File Your Claim

Under Florida law, your employer is required to file your claim to its insurance company within seven (7) days of them becoming aware of your injury. You will then be sent additional information from the insurance company.

Consult an Attorney

Workers' Compensation laws can be very confusing and you may not be receiving all of the compensation you are entitled to. It is important to consult an attorney to make sure that the insurance company is not taking advantage, or failing to provide you the benefits you deserve.
